TERMS OF SERVICE (TOS)PrintDisclosure to Law Enforcement: Subscriber agrees that Plutomic Hosting may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition Plutomic Hosting shall have the right to terminate all service set forth in this Agreement. Support Boundaries: Our support team will support items relating directly to the services we provide. This means that we will not provide support for any 3rd party applications, cgi programs, or html. Service Rates: Subscriber acknowledges that the nature of the service furnished and the initial rates and charges have been communicated to Subscriber. Subscriber is aware that Plutomic Hosting may prospectively change the specified rates and charges from time to time. The promotional offer is contingent upon Plutomic Hosting achieving and maintaining its cost of service goals including but not limited to rates charged to Plutomic Hosting by its suppliers. Payments and Fees: Credit cards that are declined for any reason are subject to a $1.00 declination fee. Service will be interrupted on accounts that reach 10 days past due. Service interrupted for nonpayment is subject to a $200 reconnect charge. Accounts not paid by due date are subject to a $10.00 late fee. Accounts that are not collectable by Plutomic Hosting may be turned over to an outside collection agency for collection. Refunds and Disputes: All payments to Plutomic Hosting are nonrefundable. All bandwidth and other overages will be added on to your monthly bill. Any dispute over these incurred overages must be submitted no more than 15 days after the last billing cycle has ended. Plutomic Hosting has a zero tolerance policy for chargebacks. Any customer who disputes a credit card payment is subject to a fine, suspension and account termination at Plutomic Hosting's discretion. A charge of $40.00 per chargeback will be assessed to all accounts that receive a chargeback. Plutomic Hosting will be the sole arbitrator of any dispute. Recurring Billing: We usually DO NOT send out invoices. All credit cards are billed automatically monthly, quarterly or semi-annual. It is the client’s responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, as a courtesy we will send an email notification at which point we will need to be provided with another credit card within 24 hours. If we do not receive a response within 24 hours the account will be deactivated. Currency: All prices are in US-Dollar. We are not responsible for any currency exchange fees from your credit card company or your bank. Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of Plutomic Hosting and that damages resulting from any interruption of service are difficult to determine. Therefore, subscriber agrees that Plutomic Hosting shall not be liable for any damages arising from such causes. In no event shall Plutomic Hosting be liable for any special or consequential damages, loss of data or injury. Viruses and Other Destructive ActivitiesIf your account is found to contain illegal activity, illegal MP3 Files, pirated software, hacker programs, warez programs, or any other illegal files, your account will be terminated immediately without notice and a $25.00 Cancellation fee will apply. Also the proper federal and your local authorities will be notified of your actions. Spamming: Plutomic Hosting takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM over our network. Simply stated this means that customers of Plutomic Hosting may not use or permit others to use our network to transact in UCE. Customers of Plutomic Hosting may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. In addition, it is not acceptable to transmit bulk email through remote SOCKS, HTTP or other similar proxies who consecutively make a SMTP (TCP port 25) connection to the destination mail servers. This technique may result in account suspension or termination. Violations of this policy carry severe penalties, including termination of service and possible legal action. In order to prevent unnecessary blacklisting due to spam we reserve the right to occasionally sample bulk email being sent from servers. Any type of activity that Plutomic Hosting constitutes to be ‘spamming’ will result in fines of up to $300 to pay for administrative action required to correct any problems caused by spamming. Plutomic Hosting will be the sole arbitrator in deciding what constitutes spamming. Subscriber acknowledges that by continuing to use Plutomic Hosting services they agree to the Terms of Service in its entirety. Breach of the terms of service at any point will result in immediate suspension and/or termination. Adult Content: Plutomic Hosting does not allow any type of adult content, links to other sites providing adult content and mentions of adult content. Child Pornography: The use of Plutomic Hosting’s services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. Plutomic Hosting is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services. Force Majeure: Plutomic Hosting will not be liable for delays in its performance of the TOU or Plutomic Hosting services caused by circumstances beyond Plutomic Hosting's reasonable control, including acts of God, wars, insurrection, civil commotions, riots, national disasters, earthquakes, strikes, fires, floods, water damage, explosions, shortages of labor or materials, labor disputes, transportation problems, accidents, embargoes, or governmental restrictions (collectively "Force Majeure"). Plutomic Hosting will make reasonable efforts to reduce to a minimum and mitigate the effect of any Force Majeure. Not withstanding anything contained elsewhere herein, lack of finances will not be considered an event of Force Majeure nor will any event of Force Majeure suspend any obligation of customers for the payment of money due to Plutomic Hosting. Denial of Service: We reserve the right to refuse service to anyone, for any reason, at anytime. |
